In force from their publication on https://art.zaitsev.work.

1. Seller

Artem Zaitsev, artist, sole trader (entrepreneur individuel), France — 96 avenue Philippe-Auguste, 75011 Paris — phrrrtem@gmail.com. SIRET (artist-author): 92461087600014 · SIRET (micro-enterprise): 92461087600014.

2. Scope

These terms apply to every order placed on the website by a consumer. Placing an order means accepting these terms, which are available on the website at all times.

3. Works on sale

Originals and limited editions come with a certificate of authenticity. Photos and videos are as faithful as possible; small colour differences may remain depending on your screen.

4. Prices

Prices are in euros, all taxes included. VAT not applicable, art. 293 B of the French General Tax Code. Shipping costs are calculated in the cart for the chosen country and shown before payment. Pickup at the Paris studio is free.

5. Order and payment

Payment is made online through Stripe (card, Apple Pay, Google Pay). When you go to payment, the works in your cart are held for the length of the payment session (about 30 minutes); if no payment is made by then, they become available again. The order is binding once payment is confirmed; a confirmation email with the invoice is then sent.

6. Delivery

Delivery to France and the countries of the European Union, or free pickup at the Paris studio. Works are carefully packed; ceramics are double-boxed. Unless another date is given when ordering, delivery takes place no later than 30 days after the order. For delivery outside the European Union, contact the seller.

7. Right of withdrawal

Consumers have 14 days from receiving the work to withdraw from the purchase without giving a reason (art. L221-18 of the French Consumer Code). Send a clear statement to phrrrtem@gmail.com.

The work must be sent back in its original packaging and in perfect condition no later than 14 days after you communicate your decision. Return costs are paid by the buyer. All payments received, including the initial delivery cost (based on standard delivery), are refunded within 14 days of receiving your withdrawal; the refund may be withheld until the work has been received back.

Under art. L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to works made to order to the buyer's specifications or clearly personalised.

8. Legal guarantees

Buyers benefit from the legal guarantee of conformity (art. L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (art. 1641 et seq. of the French Civil Code). If a work arrives damaged, please report it by email as soon as possible, with photos.

9. Intellectual property

Selling a work does not transfer its copyright. The artist keeps, in particular, the right to reproduce the work to present his practice.

10. Personal data

See the privacy policy.

11. Complaints and mediation

For any complaint, write to phrrrtem@gmail.com. If a dispute is not resolved, consumers may refer it free of charge to the consumer mediator: CM2C, 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net.

12. Governing law

These terms are governed by French law. This does not deprive consumers living in another EU country of the protection of the mandatory rules of the law of their country of residence.

The French version of these terms prevails.
